Settlement for widow whose husband died in a rural car crash with no surviving witnesses

Amount$100,000.00

The Law Office of Jared A. Rose and The Law Offices of Stephen R. Bough represented a 54-year old widow whose husband had died in a rural car crash with no surviving witnesses. Investigation revealed that he was probably trying to avoid an approaching car that had crossed the center line at the top of a hill. The widow’s insurance company, Liberty Mutual had issued an uninsured motorist policy that required a hit-and-run claim to prove actual physical contact despite a state law saying that coverage exists regardless of whether physical contact is made.

The claim was settled for the uninsured motorist insurance policy limits of $100,000, consisting of two equal stacked payments of $50,000 for each car listed on the policy. The settlement was report in Missouri Lawyers Weekly.
